In a recent development, the Delhi State Consumer Disputes Redressal Commission upheld a District Forum’s ruling, holding GTB Hospital and two doctors accountable for negligence and delay in the treatment of a cancer patient. The commission affirmed the order directing the hospital and doctors to jointly pay a lump sum compensation of Rs 5 lakhs to the heirs of the deceased patient.
The case revolves around Mr. Singh, a senior Mali in the PWD Department under the Government of NCT of Delhi, enrolled in the Delhi Govt. Employees Health Scheme. Singh, facing an unusual growth in his mouth in April 2005, sought assistance at GTB Hospital, where a biopsy confirmed “Squamous Cell Carcinoma (Oral Cavity Cancer)” after a month-long diagnostic delay.
Despite an initial tumor size of just one square centimeter, alleged negligent treatment led to a worrying increase to 3 square centimeters by July 2005. Subsequent visits to the hospital proved futile, with Singh claiming to receive no proper treatment. A planned surgical intervention in May 2005 was further marred by a postponed operation, leaving the patient in a dire situation.
The District Commission’s order, upheld by the State Commission, emphasized the hospital and doctors’ apathetic approach and lack of timely clinical judgment. The bench dismissed GTB Hospital’s appeal, asserting that expert medical opinion is crucial in determining negligence in the field.
This case highlights the pressing need for accountability in healthcare, urging institutions to prioritize timely and effective treatment, preventing tragic outcomes.
